The Supreme Court is set to deliver its crucial judgment on Monday, September 15, 2025, regarding a petition seeking to halt the implementation of the contentious Waqf (Amendment) Act, 2025. Over a hundred petitioners have vehemently opposed the law, branding it as a ‘creeping acquisition’ that threatens Muslim properties. Conversely, the government has staunchly defended the Act, asserting its necessity to combat ‘rampant encroachment’ on both public and private lands. This significant legal battle landed before the Supreme Court in early April, mere hours after the Waqf (Amendment) Bill of 2025 received parliamentary approval. A central point of contention revolves around the Act’s provision granting the power to denotify properties previously recognized as ‘waqf’ through court rulings, established usage, or formal deeds. The Supreme Court bench, under the leadership of Chief Justice of India B.R. Gavai, dedicated three consecutive days in May to hear extensive arguments from advocates representing the challengers of the amended Waqf law, as well as Solicitor General Tushar Mehta, who presented the Centre’s defense, before reserving its interim order.
