A special fast-track court in Medchal-Malkajgiri delivered a significant judgment on Monday, sentencing a 33-year-old man to life imprisonment. The ruling pertains to a harrowing case from 2018 in Dundigal, involving the rape and subsequent abetment of suicide of a young minor girl.
Komari Shiva Kumar, residing in Indiramma Colony, Bowrampet, was identified as the perpetrator. He faced conviction under stringent sections of the Indian Penal Code (IPC) – specifically Section 376(3) for rape – and relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act, 2012. For these grave offenses, he received a rigorous life imprisonment sentence and a fine of ₹50,000. Additionally, he was sentenced to ten years of rigorous imprisonment and a ₹20,000 fine under IPC Section 306 for abetment of suicide. The court explicitly ordered that all collected fine amounts be directed as compensation to the victim’s mother, recognizing her immense loss.
Police reports detail the tragic events of June 9, 2018, when the victim’s mother discovered her younger daughter deceased, having taken her own life by hanging. Initially, a case of suspicious death was lodged at the Dundigal police station. However, during the subsequent investigation, Komari Shiva Kumar was apprehended. He confessed to having enticed the minor under false pretenses of affection, then proceeding to sexually assault her. When the traumatized girl later contacted him regarding her injuries, he cruelly threatened her, instructing her not to reach out again. Overwhelmed by distress and fear, she tragically ended her life.
In light of Shiva Kumar’s confession, the legal proceedings were intensified, with charges updated to include rape under both the IPC and POCSO Act, alongside abetment of suicide. A thorough investigation culminated in the filing of a comprehensive chargesheet, leading to the commencement of the trial.
The final judgment was delivered by Ms. N. Amaravathi, the presiding Judge of the Fast Track Special Court in Medchal-Malkajgiri, a court dedicated to the swift trial and resolution of cases involving rape and the POCSO Act. Her pronouncement marked the culmination of the legal battle, bringing a measure of justice to this deeply distressing case.
