In a significant development, the Jammu and Kashmir High Court has formally notified police and civil administration officials regarding a petition. This petition was filed by Aam Aadmi Party (AAP) legislator Mehraj Malik, who is currently detained and hails from the Doda district, challenging his arrest.
Following a review of Mr. Malik’s petition, which contests his detention under the stringent Public Safety Act (PSA), Justice Vinod Chatterji Koul directed a formal notice to be sent to key government and law enforcement figures. These include the Principal Secretary of the Home Department, the District Magistrate of Doda, the Senior Superintendent of Police for Doda, and the Superintendent of District Jail, Kathua.
The court has set October 14 as the deadline for these officials to submit their detailed responses, marking the next scheduled hearing date.
Mr. Malik’s arrest on September 8 followed the circulation of an online video where he allegedly used inappropriate language against Harvinder Singh, the Deputy Commissioner of Doda. This incident reportedly stemmed from a dispute over outstanding payments owed to a local individual.
A formidable legal team, featuring prominent senior advocate Rahul Pant alongside Appu Singh Salathia, M. Zulkarnain Chowdhary, and Joginder Singh Thakur, is representing Mr. Malik. His arrest has already ignited considerable unrest and violent protests within the Doda region.
The legal counsel emphasized to the court the urgent nature of the case, highlighting that Mr. Malik, as an elected representative (Doda MLA), is essential for fulfilling his public duties. They pressed for an expedited hearing, underscoring the importance of his role.
Furthermore, Mr. Malik is seeking a substantial compensation of ₹5 crore from the named officials, citing a severe violation of his fundamental rights and an unwarranted restriction of his personal liberty.
