National Human Rights Commission Issues Notices to States Over ‘Inhumane Treatment’ of Vendors

In a significant move, the National Human Rights Commission (NHRC) has issued notices to all states and Union Territories across India. This action comes in response to a complaint alleging that municipal authorities are subjecting roadside vendors and hawkers to “unnecessary and inhumane treatment.” The NHRC has called for an inquiry into these allegations, as documented in its proceedings from October 17.

The complaint highlights that vendors, including those selling pottery, are reportedly facing eviction and punitive actions like challans and penalties from municipal bodies in various cities. These actions are often justified by claims of obstructing emergency services like fire brigades and ambulances. However, the complaint suggests these measures are sometimes used to harass shopkeepers and extort money from vendors.

The NHRC noted that such treatment is particularly damaging as these vendors rely heavily on seasonal sales, especially during festivals like Diwali, to make their earnings. The commission views these allegations as prima facie violations of human rights.

Taking cognizance of the matter, the NHRC has directed the Chief Secretaries of all states and UTs to investigate the complaint. Municipal authorities and district magistrates have been instructed to cease such practices, which the NHRC deems contrary to the government’s ‘Vocal for Local’ initiative. The commission also stressed the importance of ensuring proper fire-fighting access and providing suitable alternative locations for displaced vendors, equipped with necessary safety measures.

Importantly, the NHRC has specifically urged local administrations to refrain from taking any harsh actions, such as issuing challans, imposing penalties, or seizing goods, against these vendors during the Diwali festive season. These directives are to be implemented strictly for the Diwali period and not to be misconstrued as a blanket permission for the rest of the year.

The NHRC has requested an action-taken report within two weeks.
